Please read this End-User License Agreement (“Agreement”) carefully before purchasing or using Revenue Detective/BBC Consulting website visitor identification software (Does not apply to trial version)
By using the Application, you are agreeing to be bound by the terms and conditions of this Agreement.
If you do not agree to the terms of this Agreement, do not purchase or use the Application.
Revenue Detective/BBC Consulting grants you a revocable, non-exclusive, non-transferable, limited license to download, install and use the Application solely for your personal, non-commercial purposes strictly in accordance with the terms of this Agreement.
You agree not to, and you will not permit others to:
a) license, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the Application or make the Application available to any third party.
Modifications to Application
Revenue Detective/BBC Consulting reserves the right to modify, suspend or discontinue, temporarily or permanently, the Application or any service to which it connects, with or without notice and without liability to you.
This Agreement will automatically renew upon expiration, your payment method on file will be billed in the amount of the program pricing specified in the original agreement unless otherwise notified.
Term and Termination
This Agreement shall remain in effect for the duration of the chosen program or until terminated by you or Revenue Detective/BBC Consulting.
Revenue Detective/BBC Consulting may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice.
This Agreement will terminate immediately, without prior notice from Revenue Detective/BBC Consulting, in the event that you fail to comply with any provision of this Agreement.
Upon termination of this Agreement, you shall cease all use of the Application and delete all copies of the Application from your mobile device or from your desktop. No refunds will be given after initial purchase unless the purchase was a fraudulent activity.
If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Amendments to this Agreement
Revenue Detective/BBC Consulting reserves the right, at its sole discretion, to modify or replace this Agreement at any time. If a revision is a material we will provide at least 30 (changes this) days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
No refunds are allowed unless the transaction was the result of fraudulent activity.
If you are issued a refund, it should appear on your credit card within 72 hours upon us notifying you. If paid by check, you will receive a refund within 10 business days after the request.
Limitation of Liability
To the extent not prohibited by law, In no event shall application provider by liable for personal injury, or any incidental, special, indirect or consequential damages whatsoever, including, without limitation, damages for loss of profits, loss of data, business interruption or any other commercial damages or losses, arising out of related to your use or inability to use the licensed application, however caused, regardless of the theory of liability (Contract, tort of otherwise) and even if the application provider has been advised of the possibility of such damages, some jurisdictions do not allow the limitations of liability for personal injury, or of incidental or consequential damages, so this limitation may not apply to you. In no event shall applications providers total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount of fifty dollar ($50.00). The forgoing limitations will apply even if the above stated remedy fails of its essential purpose.
